Ojukwu family withdraws suits over property dispute

Three of the suits arising from family tussle over the properties left behind by the late Ikemba Nnewi, Chief Chukwuemeka Odumegwu-Ojukwu, might have been resolved out of court.



The Lagos High Court sitting in Igbosere struck out the suits following the notice of discontinuance. One of the suits was initially instituted against the former warlord’s wife, Bianca.

The other suit was instituted against  “unknown persons”.

The trial judge, Justice Adedayo Oyebanji, struck out the two other separate suits with numbers LD/1682/12 and LD/1681/12, filed against unknown persons occupying two separate properties of the firm.

Some members of the family had instituted the suits through one the deceased’s company, Ojukwu Transport Limited.

The claimant was seeking to be paid a total of N280m as compensation and accruable rents on two of the deceased’s houses located at 29 Oyinkan Abayomi Drive (formerly Queens Drive), Ikoyi, and at 13, Ojora Road (Hawksworth Road), Ikoyi.

The company had sought the court to take over the properties, and demanded a payment of N80m being expected rent of the two houses from September 27, 2012, until the defendants give up possession.

It also prayed the court to order 21 per cent interest on the accrued sums until judgment is given and five per cent interest until the entire sum is fully paid.

In addition, it sought N100m damages on the suits instituted against the unknown persons.

“The claimant, through its counsel, Ikechukwu Ubahakwe, on Monday informed Justice Adedayo Oyebanji, of its pending notice of discontinuance of the action, dated February 5, 2013. The suit was numbered LD/1680/12.

Bianca’s counsel, Nick Omeha, who did not object to the application which was seeking the withdrawal of the suit, had sought for N100,000 cost against the claimants.
